En el marco del Convenio de Colaboración entre la Corporación de Asistencia Judicial RM y el Servicio Nacional de la Discapacidad, SENADIS se realizó la jornada de capacitación “Nuevo paradigma de la discapacidad y Acciones judiciales en materia de inclusión” para profesionales de ambas instituciones y de las CAJs del Norte, Valparaíso y Centro Sur. 

El objetivo de la actividad fue capacitar a abogados de la CAJ y público en general en relación a la naturalización de la discapacidad y empatía con la diversidad: Cuándo y cómo se discrimina y qué sanciones contempla la ley para los actos de discriminación. 

Paulo Quezada Alese, Director de la Corporación de Asistencia Judicial de la Región Metropolitana, y Evelyn Magdaleno Gutiérrez, Directora Regional Metropolitana del Servicio Nacional de la Discapacidad, quienes encabezaron la actividad, señalaron que este tipo de capacitaciones pone en relieve la importancia del trabajo conjunto de las entidades públicas para beneficio de la ciudadanía, especialmente en materias como la discapacidad que requieren de los máximos esfuerzos del servicio público. 

En la primera parte del evento, los abogados del Convenio CAJ Metro Senadis de la Región Metropolitana, Paulina Bravo y Daniel Villarroel, expusieron en relación al nuevo paradigma de la discapacidad y las estrategias y acciones judiciales en materia de inclusión. 

Se expusieron los nuevos conceptos jurídicos incorporados en la Convención Internacional sobre los Derechos de las Personas con Discapacidad, recogidos por la Ley 20.422 y las acciones y materias de discapacidad de competencia de Juzgados de Policía Local; la acción de no discriminación arbitraria y sanciones; las sanciones contempladas legalmente, para funcionarios públicos y municipales que ejercen actos de discriminación y el análisis de casos atendidos por abogados ejecutores de Convenio y forma de derivación. 

En la segunda parte, se realizó una jornada de retroalimentación en la que los asistentes debatieron en relación a los antecedentes y alcances del Convenio CAJ – SENADIS; análisis de ejecución del convenio; el patrocinio judicial y los acuerdos entre las partes; la orientación e información, y los nudos críticos de cada etapa. 

Cabe destacar la presencia de los profesionales del Convenio CAJ Metro Senadis de las cuatro regiones en que se desarrolla nuestra labor (Sexta, Séptima, Duodécima y Metropolitana) y representantes del convenio con la  Corporación de Asistencia Judicial de las regiones de Tarapacá y Antofagasta (CAJTA); la Corporación de Asistencia Judicial de la Región de Valparaíso; y la Corporación de Asistencia Judicial del Biobío. 

Para Sofía Colvín Izquierdo. Abogada ejecutora convenio Senadis – CAJ Metro, región de Magallanes, el evento “permitió ver las realidades de ejecución del convenio en otras regiones, se plantearon problemas que se han presentado en  las regiones y así se han buscado soluciones colaborativas con Senadis. Además de compartir experiencias relevantes en materia de discriminación por discapacidad”. 

Cristián Martínez, abogado ejecutor en la región de los Ríos, Ciudad de Valdivia. CAJ Biobío, agregó que “ha sido importante compartir la experiencia que hemos tenido en la ejecución del convenio. Principalmente comparar la disparidad de criterio de los tribunales, los problemas en la ejecución del convenio, respecto a nuestros usuarios, como también respecto a las soluciones que les podemos ofrecer”. 

Y finalmente, Iván González, de las CAJ VAL y que ejecuta el convenio en la región de Valparaíso, puntualizó que “Siempre son valiosas estas reuniones, estas instancias nos dan pie para poder homologar nuestro actuar, enriqueciéndonos con la experiencia de otros profesionales. Por región, además se perciben variables que uno a veces no tiene, como por ejemplo la variable indígena, las conexiones que uno tiene con la región, el tamaño de la región. Esa disimilitudes puede enriquecer la labor de los otros abogados, al ver cosas que uno a veces no ve”.

Paulo Quezada Alese, Director de la Corporación de Asistencia Judicial de la Región Metropolitana y el Fiscal Regional de la Fiscalía Regional Metropolitana Centro Norte, Andrés Montes Cruz, firmaron un importante convenio de colaboración con el objeto de promover una eficiente, rápida y coordinada derivación por parte de la Fiscalía a la Corporación de Asistencia Judicial de la Región Metropolitana de las víctimas de cuasidelitos cometidos por profesionales de la salud en centros de salud públicos (negligencias médicas), brindándoles asesoría jurídica en materias penal y civil derivada de ésta, durante toda la investigación y/o procedimiento sí correspondiera.

“Para la Fiscalía Centro Norte es muy importante firmar este convenio porque implica coordinar a todo los agentes estatales que están destinados a proteger a los ciudadanos. Particularmente frente al tema de las negligencias médicas existe un acuerdo entre ambas instituciones para derivar a aquellas víctimas, que generalmente están muy desorientadas sobre las acciones seguir, especialmente en materias civiles. De allí que la firma de este convenio y la adecuada coordinación del Estado, especialmente entre Fiscalía y la Corporación en este caso, va a ser muy importante para las víctimas”, señaló Montes.

Por su parte, el Director de la Corporación de Asistencia Judicial de la Región Metropolitana, expresó que “Para nuestra institución este convenio es sumamente importante ya que nos permite fortalecer los vínculos con la Fiscalía, sobre todo en temas de negligencias médicas donde nosotros podemos ser artífices de una solución definitiva en estas materias tan delicadas, principalmente por el costo emocional que tienen. Por ello, este convenio nos ayudará a estar mejor coordinados y enfrentar de mejor manera este desafío”, concluyó.

La CAJ METRO participó activamente en la primera actividad de puertas abiertas que se realizó en el Centro Metropolitano Norte servicio del  SENAME,  que alberga jóvenes infractores de ley, ubicado en la comuna de Til Til, específicamente en la Localidad de Punta Peuco.

Esta Feria de Reinserción contó con la participación de servicios públicos e instituciones de educación con la finalidad que los jóvenes evalúen alternativas de reinserción sociocultural y laboral una vez cumplida su condena. Ya que mientras se encuentran recluidos,  trabajan en los programas de reinserción laboral y de educación y cuentan con un equipo interdisciplinario, Asistentes Sociales, Psicólogos y Terapeuta Ocupacional, quienes trabajan junto a ellos el proceso de adopción y reinserción

En la actividad estuvo presente la Seremi de Justicia, Lorena Escalona, quien destacó la presencia de los servicios públicos, señalándoles que cuentan con una red de apoyo en el medio libre, y que existen intenciones de potenciar esta coordinación que favorezca su reinserción.

En el marco de la conmemoración del Día Internacional de la no Violencia contra la Mujer, la corporación de Asistencia Judicial de la Región Metropolitana realizó una serie de actividades de promoción y difusión de los derechos de la mujer y fortalecimiento de su acceso a la justicia.

En la comuna de La Pintana realizamos una charla de promoción y difusión de derechos en relación a la prevención de abuso sexual, con la participación de instituciones municipales y organizaciones de la sociedad civil tales como Programa Jefas de Hogar, Programa “El Castillo”, Programa “Papás a la Pinta”, OPD la Pintana, CENFA, Oficina de Fomento Productivo, Colegio Marcelino Champagnat, Programa de Intervención especializada (PIE), Cesfam Santiago Nueva Extremadura, Cesfam San Rafael, Organización “Raíces” y el Programa de la Mujer De la comuna.

El día miércoles 25 de noviembre del 2015, en la comuna de La Pintana, se realizó un nuevo Diálogo Participativo de CAJ METRO. Esta actividad convocó a más de cuarenta personas, entre  vecinos y dirigentes sociales de la a comuna, los cuales debatieron y conversaron sobre los Centros Integrales de Justicia. 

La actividad contó además con la presencia del Subsecretario de la Secretaría General de Gobierno, don Osvaldo Soto, quién tiene a cargo de la División de Organizaciones Sociales, entidad encargada de supervisar la realización de este tipo de actividades. También estuvo presente el Alcalde la Municipalidad de La Pintana, don  Jaime Pávez, la consejal de la misma comuna Sra. Claudia Pizarro, el Director General de la Corporación de Asistencia Judicial Región Metropolitana don Paulo Quezada y la Directora Regional Sur (s) de la CAJ R.M. doña Paula Torres.

Estas acciones se enmarcan en el cumplimiento de la Ley 20.500 de Participación Ciudadana, la cual tiene por objetivo incorporar a la ciudadanía para que, con sus aportes y requerimientos, las instituciones de gobierno construyan sus políticas públicas y enfoquen sus esfuerzos a cumplir con las reales necesidades de las personas. 

En esta oportunidad, Raúl Paillaleve, jefe (s) de la Unidad de Atención y Participación Ciudadana, junto a Héctor Droguett, abogado de la misma unidad, explicaron el fin de la actividad, la ley de Participación Ciudadana y la labor de la Corporación de Asistencia Judicial. Por su parte,  Laura Rebolledo, abogada Jefe del Centro Integral de Justicia de La Pintana, dio a conocer los servicios que se encuentran en la comuna, las cifras de atención y la labor que hacen con las redes y la comunidad.

Los participantes al final de la actividad dieron a conocer sus inquietudes, requisitos y  aprensiones  respecto al acceso a la justicia, valorando el trabajo que realiza  CAJ Metro en la comuna. Para cerrar la actividad el Director General recogió las opiniones, destacando el llamado a capacitar a las mesas territoriales, con el fin de que ellos tengan los conocimientos necesarios en las materias y puedan transmitirlos a sus vecinos, como así también, dijo que “facilitar los trámites es una tarea pendiente por la que se está trabajando”.

El subsecretario hizo hincapié en que “Para la Presidenta es muy importante la participación ciudadana, que vayamos al territorio, conversemos con la gente, porque así se ajusta la política pública a sus requerimientos” además destacó que “los funcionarios de la CAJ hacen más que representarlos en los juicios, hacen una tremenda labor de difusión de derechos”. El alcalde quedó gratamente sorprendido con la alta convocatoria y destacó que precisamente en esta comuna se inicio el proyecto de la CAJ de los Centros Integrales de Atención a Víctimas y además se comprometió con la directora regional para informar a la comuna. 

Entre los días 09 y 11 de noviembre se celebró en Hong Kong, Región Administrativa Especial de la República Popular China, la Conferencia Global sobre cobro de Alimentos Internacionales en el Asia Pacífico y el Mundo (Global Conference on the Recovery of Child Support and Family Maintenance in Asia Pacific and Worldwide), organizada por la Oficina para Asia Pacífico de la Conferencia Permanente de La Haya de Derecho Internacional Privado (HCCH) y el Departamento de Justicia de la Región Administrativa Especial de Hong Kong. La conferencia se realizó en la Facultad de Derecho de la Universidad de Hong Kong y contó con participantes de diversos países de Asia, Oceanía, Europa y del continente americano, incluyendo a expertos de Estados Unidos, Canadá, Brasil y Chile, donde destacamos la activa presencia de profesionales de la Corporación de Asistencia Judicial RM. 

En dicha conferencia expusieron Verónica Valenzuela, trabajadora social de la Oficina Internacional de nuestra Institución, quién efectuó una ponencia denominada “International Conventions and their application in new family realities” (Convenciones internacionales y su aplicación en las nuevas realidades familiares)  y el abogado Juan Francisco Zarricueta, actual Director Regional Metropolitano Norte (S) y especialista en materia de Alimentos Internacional, quien realizó una presentación denominada “Mandatory Mediation and Maintenance Obligations under the Chilean law” (Mediación obligatoria y obligaciones alimenticias bajo la ley chilena). 

Ambas ponencias fueron seleccionadas dentro de varias decenas de propuestas efectuadas por expositores de distintas partes del mundo, lo que por cierto nos llena de orgullo al comprobar que 2 de los 3 expositores chilenos pertenecen a nuestra institución. La otra expositora de Chile fue la Magistrado Nel Greven, jueza del Juzgado de Familia de Pudahuel, quién expuso sobre la Convención de los Derechos del Niño y las Obligaciones Alimenticias, enfocándose en la Pobreza Infantil y los Derechos Económicos.

La Oficina Internacional de la Corporación de Asistencia Judicial Región Metropolitana, es el organismo oficial en Chile encargado de hacer cumplir las obligaciones de la  Convención de Nueva York de 1956 sobre la Obtención de Alimentos en el Extranjero. Lo que significa, que son ellos precisamente quienes tramitan las causas tanto de chilenos que solicitan alimentos al exterior como de extranjeros, o chilenos residentes afuera, que solicitan alimentos en Chile.

En el Edificio del Sindicato del Banco Estado se realizó el Primer Encuentro de Innovadores Públicos del Laboratorio de Gobierno, ocasión propicia para reconocer públicamente los proyectos adjudicados en el Concurso de Gestión de la Innovación en el Sector Público (GIP) 2015, entre las que destaca la CAJ METRO. Entregando simbólicamente a sus máximas autoridades una caja de herramientas, para ejecutar su proyecto GIP  2015.  

El concurso es realizado por CORFO a través  el Laboratorio de Gobierno,  con el objetivo de que los distintos servicios Públicos puedan instalar una cultura y permanentes prácticas de innovación, que  faciliten   la  generación e  implementación de  soluciones, para que estas agreguen valor público a los servicios  y productos que otorgan, tanto interna como externamente.

Los funcionarios públicos y en especial la CAJ RM, deben  enfrentar escenarios cada vez más complejos, pues ofrecen una alta heterogeneidad de servicios dirigidos a distintos usuarios, lo cual hace difícil vincular estos “productos” con resultados y medir adecuadamente la valoración. Lo anterior requiere incorporar al trabajo diario nuevos planteamientos, tendencias sociales, culturales y de gestión pública, que permitan reconocer a la función pública como un proceso que crea valor.

Esta iniciativa desarrolla nuestra política institucional, fortaleciendo la participación de nuestros funcionarios, quienes serán actores relevantes y empoderados en la creación y desarrollo de iniciativas innovadoras que  mejoren  nuestros procesos, relevando y sistematizando conocimientos, habilidades y actitudes necesarias para la creación de soluciones innovativas,  lo que  redundará en mejoras en la calidad de atención de los usuarios.

El director general de la CAJ METRO, Paulo Quezada, recibió el reconocimiento a nombre de nuestra institución. Junto a él estuvieron Verónica De Andraca, abogada Asesora de Proyectos de Dirección General y Ricardo Wurgaft Director Ejecutivo de Aukan, Gestión de Innovación Dictuc – Universidad Católica. Además concurrieron a la actividad  Raúl Paillaleve, Jefe (S) de Unidad de Atención y Participación Ciudadana; Alexis Alé, Jefe Departamento Administración; Cynthia Bulicic, Jefa (S) del Departamento de Planificación y Control del Gestión. 

La actividad contó con la presencia de Rodrigo Egaña Baraona, Director Nacional del Servicio Civil y Presidente del Consejo de Alta Dirección Pública, quien abogó por la necesidad de fortalecer los procesos de innovación en el sector público para un mejor servicio a la ciudadanía.

Por motivo de la conmemoración de la Convención de los Derechos del Niño, el Centro Integral por los derechos de los niños, niñas y jóvenes (Creden) de la Corporación de Asistencia Judicial RM, participó en el “Carnaval por los Derechos de la Infancia” en la comuna de El Bosque.

El día sábado 21 de noviembre se realizó el recorrido del carnaval, el que se desarrolló por la Escuela Mario Arce Gática, Portales, Los Mimbres, Julio Covarrubias, Jorge Luco, Eleuterio Ramírez, terminando en la Plaza Lo Lillo, donde se encontraban los stand de información de los participantes de La Red de Infancia y Adolescencia de El Bosque.

Las Trabajadoras Sociales del Creden,   Carolina Castro y Mabel Pizarro participaron entregando informativos y dando orientación a los asistentes sobre la oferta integral que ofrecen, la que incluye tanto trabajadores sociales, psicólogos y abogados que defienden los derechos de los niños, cuando estos han sido vulnerados.

La actividad contó con  grupos de música y actividades de diversión para los asistentes, los que motivados por el carnaval asistieron a la actividad y se llevaron la información que los distintos participantes les entregaron. 

El pasado jueves 26 de noviembre la Corporación de Asistencia Judicial de la ciudad de Cauquenes, región del Maule, realizó una capacitación conjunta con el Registro Civil e Identificación de la Región del Maule y el Club de Abogados de Cauquenes, sobre “Acuerdo de Unión Civil, análisis de la ley 20.830”.

A esta actividad, realizada a las 15 horas en el salón de la Gobernación Provincial de Cauquenes, asistió la Directora Regional del Servicio de Registro civil doña Paula Troncoso Vergara, el Presidente del Club de Abogados de Cauquenes don Humberto Cuevas Badilla y el abogado jefe de la Corporación de Asistencia judicial de Cauquenes Julio Córdiva Astudillo, quién realizó una introducción sobre este tema, el cual fue desarrollado en profundidad por la abogada del Registro Civil Gissela Castillo. La Directora Regional por su parte, dio una visión de la ley desde el punto de vista de su implementación por los funcionarios del Servicio. Asistieron además, abogados, asistentes sociales y público en general de la ciudad.

Además el lunes 30 de diciembre en Pelluhue, región del Maule, la Corporación de Asistencia Judicial de Chanco realizó una charla sobre la misma materia, destinada a los vecinos de la localidad. El lugar elegido fue la Unión Comunal de Juntas de Vecinos de Pelluhue, donde el abogado jefe Rodrigo Piña Flores y la asistente social Patricia Manríquez Orellana explicaron a los asistentes la implicancia de la Ley de Acuerdo de Unión Civil en sus aspectos prácticos. En la oportunidad, FONASA Cauquenes difundió su política social en torno a los usuarios de dicho servicio y Bienes Nacionales actualizó a los dirigentes vecinales en regularización de títulos de dominio.

El centro de Cauquenes se encuentra ubicado en Claudina Urrutia 235 y atiende de lunes a viernes de 8:30 a 17:30 horas.

El centro de Chanco se encuentra ubicado en Freire 103 y atiende de lunes a viernes de 9:00 a 13:30 horas.

El Director General de la Corporación de Asistencia Judicial de la Región Metropolitana, Paulo Quezada Alese, y el Director Nacional de SENADIS, Daniel Concha Gamboa, interpusieron un Recurso de Protección en la Unidad de Protecciones de la Corte de Apelaciones de Santiago, con el objeto de salvaguardar los derechos fundamentales de las personas que tiene el síndrome de Tourette.

La acción fue interpuesta por los abogados del Convenio CAJ Metro – Senadis de la Región Metropolitana, Paulina Bravo y Daniel Villarroel en contra de Chilevisión SA que emite el programa “Perros de la Calle”, esto debido a que en uno de los segmentos del programa antes mencionado, interviene un personaje denominado “Taldo Zúñiga”, el que pretendiendo ser un analista político, comenta temas de contingencia nacional. Sin embargo, los comentarios que realiza pasan a un segundo plano, puesto que en realidad el personaje en cuestión pretende caricaturizar, mofarse y ridiculizar indiscriminadamente a las personas con discapacidad que presentan Síndrome de Tourette, atribuyéndose con fines de espectáculo, el carácter de hijo de Agustín Arenas Troncoso, a quien en razón de un video virilizado en internet, se le apodó como “Súper Taldo”.

Fue en la transmisión del programa del 8 y el 22 de noviembre, donde la función del personaje “Taldo Zúñiga”, hace comedia mediante la ridiculización y burla de una discapacidad que presentan muchos chilenos en la actualidad, y respecto de la cual diversas organizaciones y el propio Estado de Chile han trabajado arduamente.

El Director General de la Corporación de Asistencia Judicial de la Región Metropolitana, Paulo Quezada Alese, manifestó “Estamos haciendo carne este compromiso de ambas instituciones, luchar contra la discriminación y por ello, deseamos hacer presente al país que no vamos a permitir este tipo de acciones y vamos a interponer todas los recursos que se requieran para evitarlas.” 

Por su parte, el Director Nacional de SENADIS, Daniel Concha, señaló que “Lo más importante es que ambas instituciones públicas estamos junto a la “Fundación Amigos del Tourette” para presentar un recurso en contra de Chilevisión por discriminar y ridiculizar a las personas que esta afectadas por este síndrome.

Finalmente, Andrea Pizarro; Presidenta de la “Fundación Amigos del Tourette” declaró “Nosotros vamos a presentar este recurso porque nacimos para defender los derechos de nuestros hijos y familiares, especialmente en la inclusión social, laboral, escolar…El síndrome de Tourette no es un chiste y esta mofa pública hace un daño, ya que ellos son conscientes de los movimientos y sonidos involuntarios  que realizan y estas burlas les hace daño y los estigmatiza socialmente. También deseamos agradecer esta asesoría de ambas instituciones que ha sido muy valiosa para nosotros.”

El objetivo de la presentación de este recurso legal, es solicitar que se saque de pantalla al personaje, que el programa pida disculpas públicas y que se entregue un espacio en el mismo programa para generar conciencia sobre el síndrome de Tourette.

En el recurso de protección se indica claramente que “la forma en que se aborda la sección del programa atenta contra el derecho a la igualdad, a la dignidad y a la honra de personas que tienen el Síndrome de Tourette y de las demás personas con discapacidad, que por décadas han luchado por el respeto de sus derechos y la inclusión social en igualdad de condiciones con las demás”.“El mofarse abiertamente de las personas con dicho síndrome vuelve a catalogar a las mismas como ‘distintos’ y como ‘sujetos de burla’, propendiendo a una actitud de la sociedad en este mismo sentido y generando como consecuencia un retroceso enorme en el trabajo desarrollado hasta la fecha por parte de las asociaciones para la rehabilitación e inclusión social de las personas que presentan el Síndrome de Tourette, sus familiares, y la sociedad en general”.
